And not in the Montana Boyz way.  It's the embarrassing Montana government who thinks we can't think for ourselves way.

Wait until you see the Big Brother BS coming out of Helena.  I've said it before and I'll keep saying it as long as I'm able, we need to vote out these Mother Hens.  I don't need some Montana Representative deciding what internet sites I can use. Neither do you, I imagine.

Didn't these fools learn anything when all of their new abortion stuff was overturned?  MORE Montanans than just the women folk, are affected by this.  How could they possibly think that we'd be ok with it?

Overview Of The Attempted TikTok Ban Case In Montana

Short and not so sweet, in April 2023, The Montana House of Representatives voted for a total TikTok ban in Montana.  In May 2023, Montana Governor Greg Gianforte signed the ban into law which was to take effect in January 2024.  In October 2023, TikTok and some influencers took Montana to court and wound up in the court of District Judge Donald Molloy. In November 2023 Molloy issued a temporary injunction against the ban stating

"the ban “oversteps state power and infringes on the Constitutional right of users and businesses” while singling out the state for its fixation on purported Chinese influence. Despite the state’s attempt to defend (the law) as a consumer protection bill, the current record leaves little doubt that Montana’s legislature and Attorney General were more interested in targeting China’s ostensible role in TikTok than with protecting Montana consumers. This is especially apparent in that the same legislature enacted an entirely separate law that purports to broadly protect consumers’ digital data and privacy.  The state hasn’t offered any evidence of TikTok’s allegedly harmful data practices"

The Daily Interlake reports that the appeal brief argues that the negotiations between the feds and TikTok are on-going and sealed that there can be no conflict with this case. They argue Molloy looked at comments made my legislators and the Attorney General that were biased against China, and flipped the burden of proof at the preliminary stage so that the state had to actually PROVE their consumer protection arguments instead of offering just their opinion, and finally, they state (from the Daily Interlake) "that neither the creators nor TikTok can show they will suffer irreparable economic harms that outweigh the state’s consumer protection interests."

The Plaintiffs in the case have until April 29th to answer.

We, as a state, need to vote these fools OUT in November.
